Two separate duties, with two separate dates. Section 52 sets and publishes the indicators. Section 71 assesses performance against them and publishes the assessment. They are not one duty and this site never writes them as one.

Key performance indicators

  • In force 24 February 2025
  • Applies to a public contract with an estimated value of more than £5 million.
  • At least three key performance indicators must be set before the contract is entered into.
  • The indicators must be published.
  • The duty does not bite where the authority considers that performance under the contract could not appropriately be assessed by reference to key performance indicators.

Assessment of contract performance

  • In force 1 January 2026
  • Performance must be assessed against the key performance indicators set under section 52.
  • The assessment must happen at least once every 12 months.
  • It must happen again when the contract is terminated.
  • Information about the assessment must be published.

Taking account of social value in the award of contracts

  • Published 13 February 2025
  • Mandatory from 1 October 2025, for procurements commenced under the Procurement Act 2023 on or after that date
  • Social value must carry a minimum weighting of 10% of the total evaluation score on in-scope central government contracts. The floor is 10%, never 5%.
  • The weighting is a share of the score, not a score in itself.
  • The social value model is structured around five national missions, listed below.
  • Whether any given procurement is compliant is a judgement for the contracting authority, not something a weighting alone settles.

Contract award criteria

  • In force since 17 April 2014, as transposed by each member state
  • Contracts are awarded on the most economically advantageous tender, assessed on a best price-quality ratio.
  • Criteria may include qualitative, environmental and social aspects.
  • Every criterion must be linked to the subject matter of the contract.

Conditions for performance of contracts

  • In force since 17 April 2014, as transposed by each member state
  • Special conditions may be laid down on how a contract is performed, including economic, innovation related, environmental, social and employment related considerations.
  • The conditions must be linked to the subject matter of the contract.
  • They must be stated in the call for competition or in the procurement documents, so they are known before anyone bids.

Themes, Outcomes and Measures, with proxy values

  • Published in dated editions. 2023-24 is widely cited
  • A measurement framework, not legislation. It turns a social value commitment into a monetary proxy so two bids can be compared on the same basis.
  • CrowMark prices PPN 002 commitments against National TOMs conventions. That is an alignment to the conventions, not a full National TOMs implementation, and this site says so wherever the pricing is described.
  • Editions differ. Take proxy values from the edition your buyer names, not from ours.

What this page is, and what it is not.

The duties above are UK public sector duties, used across this site as the worked example, because they are published and can be checked. Promising something in a bid and then evidencing it is the same work in the EU and in private sector procurement; only the instrument changes.

None of this is a claim about CrowAgent's performance. They are the rules the reader is already held to. This site publishes no win rates, and refusing to publish one is a position rather than an omission.
