1 April 2028 PROPOSED

Band C deadline for commercial property - proposed, not enacted

The UK government has consulted on raising the minimum non-domestic MEES rating from Band E to Band C by 1 April 2028. As of May 2026 this is a proposed regulatory target only - the implementing statutory instrument has not been laid before Parliament.

  • Source: Non-Domestic Private Rented Sector - Minimum Energy Efficiency Standards: EPC Band B by 2030 consultation.
  • Treatment: treat Band C 2028 as a planning assumption with material commercial impact - but not as current law.
  • Until the amending SI is made, only Band E is enforceable as a matter of UK law.

Band E becomes fully enforceable for all let commercial property

From 1 April 2023, a landlord may not continue to let a non-domestic property in England or Wales with an EPC rating of F or G unless a valid exemption is registered. This closed the gap left in 2018.

  • Power: SI 2015/962 reg 27 (continued letting prohibition) commenced 1 April 2023.
  • Penalty: SI 2015/962 reg 39 - penalty calculated on rateable value, not a flat fine. Max £150,000 for long breach.
  • Publication: additional named publication on the PRS Exemptions Register.

Band E required at lease initiation

From 1 April 2018, a landlord could not grant a new lease (including a renewal or extension) on a non-domestic property with an EPC rating of F or G unless a valid exemption was registered. This gave the market five years' notice.

  • Power: SI 2015/962 reg 23 - restriction on granting a new tenancy of sub-standard property.
  • Exemptions: register opened for high-cost, consent refused, devaluation, and listed-building wall insulation.
  • Enforcement: relevant local weights and measures authority (typically Trading Standards).

SI 2015/962 made - Energy Efficiency (Private Rented Property) Regulations

The parent MEES instrument created the framework for both domestic and non-domestic regimes. It set the minimum standard at Band E with phased commencement from 2018 to 2023.

  • Made under the Energy Act 2011, ss. 49 to 53.
  • Created the PRS Exemptions Register and the penalty notice powers.
  • Shared parent SI but separate parts for domestic vs non-domestic.
